Buyers/Bidders who are, or desire to be, represented by a Broker/Agent please see the Broker Participation and Buyer Registration - Terms and Conditions (below), PRIOR to registering to Bid, Viewing the Property, or contacting the listing Brokerage Agnes Gates Realty or the Agents of Agnes Gates Realty.  If you don’t follow these instructions your Broker/Agent will not be compensated, NO Exceptions!

Commission to participating Broker/Agent who properly registered Buyer/Bidder is 3% of the sale price/high bid price, as long as Buyer/Bidder closes on the property per the real estate contract terms and conditions.  The 3% commission does not apply to the Buyer’s Premium charged above the sale price/high bid price.

Property is offered for auction with a Reserve Price and with Seller accepting offers via the Listing Broker during the auction term.  If the Reserve Price is not met, all bids will be cancelled, and all bids will be null and void.  If Seller accepts an offer presented through the Listing Broker before the end of the auction term, the auction will be cancelled, and all bids will be cancelled, and all bids will be null and void.

Listing Broker reserves the right to make changes to this auction, including but not limited to the auction closing date, inspections dates, minimum bid amount, reserve price amount, etc.

Sale is an ALL CASH SALE, No Financing Contingencies allowed in the contract, NO EXCEPTIONS!

The property will be sold in AS-IS condition, with no guarantees or warranties other than free and clear title insured to Buyer.  Buyer/Bidder can inspect the property personally and/or have inspections of the property at their own expense, and must do so prior to making an offer, or bidding on the property, inspections of any kind cannot be a stipulation of the bid/offer, nor contract.  Buyer to pay the customary Buyer’s closing costs, in addition to the sale/high bid price, and Buyer’s premium.

High Bid and all offers presented through the Listing Broker are subject to a Buyer’s Premium of 10%.  Example ($50,000 high bid/private offer + $5,000 Buyer’s Premium ($50,000 x .1 = $5,000) equals a total purchase price of $55,000.00.

The purchaser/buyer whether by Highest Bidder who has met the Reserve Price, or one who has presented an offer through the Listing Broker and the offer has been accepted by the Seller, shall do the following or will be banned from all future auctions.

 

1.         Sign the following documents by 3-pm the following day after the closing of the auction or acceptance of their offer through the Listing Broker by the Seller: Seller Residential Real Estate Sale Contract, Seller’s Disclosure And Condition Of Property Addendum (Residential) and Lead Based Paint Disclosure Addendum.  Contact listing Broker for copies of these documents. 

 

2.         Deliver an Earnest Money Deposit in the amount of $5,000, in the form of a Cashier’s Check made payable to the Escrow Agent Security 1st Title Company, and deliver to Listing Broker no later than 4:30-pm the following day after the closing of the auction or acceptance of their offer by Seller. 

 

3.         The Earnest Money Deposit will be NON-REFUNDABLE unless Seller cannot close with Free and Clear Title* Insured to Buyer within 30-days of signing of the documents described in paragraph 1 above.  Title Insurance to be paid for by Seller

  

3.         * Free and Clear Title will be subject to easements and restrictions of record.

 

4.         Closing to take place within 30-days of signing of the documents described in paragraph 1 above.

 

5.         Backup offers will be accepted on the property.

 

6.         Real Estate Taxes to be prorated to date of closing.
