This is an online-only auction bound by all legal rights and remedies in the state in which the auction occurs. Do not bid if you cannot agree to the terms of this contract or are not able to pay and pick up your items within the specified terms of each auction. All global site terms and conditions apply to this auction, which you agreed to in creating an account with Equip-Bid Auctions. Auction-specific terms and conditions for this affiliate are as follows.

Inspection:
 

This auction does not offer scheduled inspection dates. An appointment is needed during the posted timeframe. Please schedule a time to preview if the auction is listed as "By Appointment Only."

Payment: The default credit card on file with your account may be charged immediately at the close of the auction. If your payment is declined for any reason, you will not be able to pick up your items without paying. Regardless of pick-up location, all payment arrangements must be made within one (1) business day (M-F) of the auction closing. If invoice payment arrangements are not made by this time, you authorize your card on file to be charged for the total amount of your invoice plus a $25.00 late fee. No late fees will be removed from an invoice once they are added. 

Payment onsite is accepted at this location in the form of cash, cashier's check, Visa, MasterCard, American Express, and Discover. Invoices over $2,000 are not able to be paid by the credit card you have on file. You will need to pay with cash, wire, or a cashier’s check. Exact change is required on cash payments. We do not allow multiple forms of payment unless you receive prior written consent from Equip-Bid. An email will be sent to all winning bidders after the auction has closed with payment instructions.

If you, as the winning bidder (Buyer), do not provide sufficient funds or fail to retrieve your item(s) within the scheduled pick-up times, you may incur fees. Multiple instances of not paying or retrieving your items will result in a permanent block from the Equip-Bid site. Any bidder caught opening a new account will be charged an additional $50 with the above warnings. This is considered fraudulent bidding and is not tolerated.

Pick-Up: If you are unable to pick up your items during the scheduled pick-up times, do not bid. By bidding in an Equip-Bid auction, you are legally bound to be charged for all won items and are agreeing to remove them from the auction location. In order to pick up your won items, you will need to schedule an appointment on your invoice page. If you fail to pick up your won items within the above timeframe, your forfeit the items. The item(s) will be donated/resold at a future auction, or held for up to 5 days upon request from the bidder for a $50.00 holding fee. The bidder must contact the auction managers during the scheduled removal time in order to make these arrangements. Regardless of any agreed upon storage of your items, all invoices must be paid by the end of regular scheduled removal. You are still liable for paying for your item(s) and will be charged at the default credit card on file, regardless of whether not you have picked up the items. By bidding on this auction, you have agreed to the following:

- All funds paid towards items you have forfeited are not subject to a chargeback.

- Items that are forfeit cannot be picked up at a later date unless the bidder is notified by Equip-Bid.

Removal: Once a bidder has paid for and picked up their items, the items become the property of the winning bidder (buyer). The buyer assumes all risk of loss and damage to property from that point forward, including at the premises of the sale. Bidders (or agents working on the bidders' behalf) removing items from the property are liable for any and all damages they cause while removing items.

Shipping: Shipping may or may not be available on this auction. Please review the shipping tab of this auction prior to bidding if shipping to you would be necessary.

Refunds: If you receive an item that is in a different condition that it was listed in the description/photos, you are eligible to apply for a refund. Otherwise, we do not offer refunds as there is no written or implied warranty of items. Please utilize the option for inespection by scheduling an appointment prior to bidding. Inspection appointments can  be made by calling/texting the auction coordinator listed on the auction. Please note that refunds are processed as soon as they are received but take 4-12 business days to process and return the money to your account.

Tax-Exempt Purchases: Tax-exempt forms must be provided to each independent affiliate—tax-exempt statuses are not stored with your Equip-Bid account. If this is your first tax-exempt purchase with Holy Grail Estates LLC, contact us at 316-559-1791 After providing tax-exempt forms to this affiliate, contact us to remove tax from each invoice and we will adjust your invoice before processing your payment.

Liability: Equip-Bid and Seller's liability shall be limited to the refund of the bidder's purchase price.

Limitations: The above-stated Terms cannot be altered except in writing by Equip-Bid.

WARRANTY & CONDITIONS OF ITEMS SOLD:

All items are sold AS IS, WHERE IS, with NO WARRANTY expressed or implied by the lot number affixed to the item. This sale is to the business community as equipment and inventory without any implied or expressed warranty. Descriptions are believed to be accurate but not guaranteed. When not certain of the condition or use of an item, please bid accordingly and utilize inspection times.

CHOOSE WISELY:

We want everyone to get a good deal, and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistake. Once bidding ends, the item is contractually sold to the highest bidder and that item is the buyers property. When in doubt about condition, completeness or suitability for intended use, please bid accordingly. Holy Grail Estates, LLC reserves the right to add or remove items from an auction, split or combine lots, add minimum bids or reserve prices, cancel, suspend, extend or reschedule an item and/or auction event, and make changes to the auction closing, inspection, or removal times. Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
