JM Bidworks LLC – Auction Terms & Conditions

Buyer’s Premium

  • 18% Buyer’s Premium applies to all purchases.
  • Specific lots may have a handling fee, those will be noted on the individual lot.

 

Payment Policy

  • Invoices must be paid in full within 2 business days of auction close.
    • Failure to pay will result in forfeiture of items and account suspension, regardless of pickup/delivery arrangements.
  • Non-cash payments (credit/debit) incur a 4% processing fee.
    • This fee will be removed if payment is made by cash, cashier’s check, wire transfer (+$20), or Venmo.
  • Invoices under $2,000 may be automatically charged to the card on file unless JM Bidworks is notified before auction close of alternate payment.
  • Invoices over $2,000 cannot be paid by card. They must be paid with cash, cashier’s check, Venmo, or wire transfer (+$20 fee).
  • Declined cards will result in an additional 4% fee charged by the processor. Buyers are responsible for ensuring valid payment details are on file.

 

Tax Policy

  • Sales tax (8.25%) applies unless a valid exemption form is submitted before the auction ends.
  • Tax forms will not be accepted at load-out.
  • If tax is refunded after payment due to late form submission, a 3.99% processing fee applies, and the original card fee is non-refundable.

 

Pickup & Removal

  • All items must be removed during scheduled pickup times.
    • If pickup is not scheduled, items may be forfeited even if paid.
  • Alternate pickup times must be arranged before the last scheduled removal day. Fees apply:
    • $50 for same-day outside posted hours
    • $150 for weekday alternate pickups
    • $250 for weekend alternate pickups
  • Items left beyond 20 days after a missed alternate pickup will be forfeited and resold in the next auction. No refunds.
  • Buyers must bring proper vehicles and equipment for removal. JM Bidworks may assist with forklifts/load-out as a courtesy, but we are not responsible for damage to property, vehicles, or persons.

 

Bidding & Auction Process

  • This is an online-only auction. By bidding, you agree to all terms and are legally bound to complete your purchase.
  • Soft/Dynamic Closing: If a bid is placed within the last 5 minutes, bidding will extend until no new bids are placed for 5 consecutive minutes.
  • To avoid internet or timing issues, we recommend placing maximum bids. JM Bidworks is not responsible for missed bids due to connectivity, lag, or failure to refresh.

 

Inspection

  • Items are sold AS-IS, WHERE-IS with no warranty or guarantee.
  • Scheduled inspection times are offered prior to auction close. Buyers are strongly encouraged to inspect in person.
  • Failure to inspect forfeits any claims regarding condition or completeness.

 

Refund Policy

  • All sales are final.
  • Refunds are considered only if an item is materially different than described and the issue could not have been discovered during the designated inspection period.
  • Refunds are processed as quickly as possible but may take 4–12 business days to return to your account.

 

Liability

  • Once items are paid for and removed, they become the responsibility of the buyer.
  • JM Bidworks’ liability is limited solely to refunding the final bid price in approved refund situations.

Golf Cart and other Electric Vehicle Disclaimer:
Some golf carts and other Electric Vehicles sold through this auction may not have a VIN, title, registration, or other documentation. All such units are sold as-is, where-is, with no warranty or representation by the auction company as to VIN availability, title status, registration eligibility, legality of use, insurability, or compliance with any applicable law or private community requirement. The auction company is acting solely as agent for the seller/consignor and is not liable for any buyer’s failure to determine whether a purchased unit can be titled, registered, insured, inspected, or used for the buyer’s intended purpose. All due diligence is the sole responsibility of the bidder prior to bidding. By bidding, the bidder accepts all risks associated with the absence of a VIN or related documentation, and no refunds, returns, chargebacks, or adjustments will be allowed for these reasons.

Shipping Terms

 

·       JM Bidworks does not provide shipping services.

·       All shipping, transport, and delivery arrangements are the sole responsibility of the buyer.

·       Buyers may hire or contract their own freight company, carrier, or third-party transport service to handle pickup.

·       JM Bidworks will work with your chosen carrier to coordinate pickup during scheduled load-out times and will assist with forklift loading as a courtesy.

·       All contracts, costs, insurance, and liability for shipping rest with the buyer and their carrier. JM Bidworks assumes no responsibility for items once they leave the lot.

JM Bidworks LLC – Payment & Pickup Policy

Payment Rules

·       Invoices under $2,000 will be automatically charged to the card on file unless JM Bidworks is notified before auction close of alternate payment.

·       Notice of alternate payment must be sent by phone (254-654-7677) or email (info@jmbidworks.com).

·       Do not rely on clicking “Pay On Site” in your bidder dashboard — it may not be seen in time. You must call or email to confirm alternate payment.

·       A 4% non-cash processing fee applies to all online card payments.

·       If your card is declined for any reason, an additional 4% fee will be applied.

·       It is the buyer’s responsibility to ensure correct card information is on file or to notify us of alternate payment before the auction ends.

 

Pickup & Load-Out Rules

·       Items must be picked up during the scheduled load-out times.

·       If you do not schedule pickup within these times, your items may be forfeited regardless of payment.

·       Alternate pickup dates may be arranged if scheduled before the final load-out day.

o   $50 fee – same-day pickup outside posted times

o   $150 fee – weekday alternate pickup

o   $250 fee – weekend alternate pickup

·       Items left longer than 20 days (after any arranged alternate pickup) will be forfeited and resold in the next auction unless prior arrangements are made.

 

Third-Party / Courier Pickups

·       Online payments are not eligible for release to a third party or courier.

·       If you need someone else to pick up items:

o   Payment must be made in cash.

o   The person picking up must present:

§  The winning bidder’s invoice (issued by JM Bidworks)

§  Proper ID of the winning bidder

·       Without both, items will not be released.

JM Bidworks LLC – Removal Policy

Removal by Appointment Only

·       All removals require a scheduled appointment.

·       Schedule your pickup directly from your invoice page by clicking “Manage Invoice.”

·       If using a phone, you may need to turn the screen sideways to see the scheduling option.

Appointment Rules

·       Appointment slots are first come, first serve.

·       If you arrive early, you must wait until your scheduled time.

·       If you miss your appointment, you will need to reschedule for another available time slot.

·       No walk-ins will be allowed.

Loading Assistance

·       JM Bidworks will assist with loading using forklifts.

·       A loading dock and a large overhead door are available for trucks/trailers to pull inside.

·       Buyers are still responsible for securing their own loads.

Alternate Load-Out Fees

If pickup is not scheduled during posted load-out times, your items may be forfeited. Alternate arrangements can be made only if scheduled before the final load-out day and will incur fees as follows:

·       $50 – Same-day pickup outside posted hours

·       $150 – Weekday alternate pickup

·       $250 – Weekend alternate pickup

Forfeiture of Items

·       Any item left longer than 20 days (beyond scheduled or alternate load-out) will be forfeited and placed into the next auction, with no refund issued, unless prior arrangements have been approved.
