This is an online-only auction bound by all legal rights and remedies in the state in which the auction occurs. Do not bid if you cannot agree to the terms of this contract or are not able to pay and pick up your items within the specified terms of each auction. All global site terms and conditions apply to this auction, which you agreed to in creating an account with Equip-Bid Auctions. Auction-specific terms and conditions for this affiliate are as follows.

Inspection: This auction does offer scheduled inspection dates. Please call the affiliate at 816-244-0865 to schedule an inspection appointment upon request within the times listed below.

Payment: The default credit card on file with your account will be charged immediately following the close of the auction. If your payment is declined for any reason, you will not be able to pick up your items without paying. Ownership of any item or lot not paid for in full by the stated deadline will revert to the Owner/Seller who may resell or dispose of the item(s) at the Seller's discretion. Payment onsite is NOT accepted at this location. Invoices over $2,000 are not able to be paid by the credit card you have on file. You will need to pay with cash, wire, or a cashier’s check. Exact change is required on cash payments. If you, as the winning bidder (Buyer), do not provide sufficient funds or fail to retrieve your item(s) within the scheduled pick-up times, you may incur fees. Multiple instances of not paying or retrieving your items will result in a permanent block from the Equip-Bid site. Any bidder caught opening a new account will be charged an additional $50 with the above warnings. This is considered fraudulent bidding and is not tolerated.

Please note: Your credit card charge will show "Liquidation Nation USA LLC" on the statement, not Stocking's Auction Service.

Pick-Up: If you are unable to pick up your items during the scheduled pick-up times, do not bid. By bidding in an Equip-Bid auction, you are legally bound to be charged for all won items and are agreeing to remove them from the auction location. In order to pick up your won items, you will need to schedule an appointment on your invoice page.

If you fail to pick up your won items within the selected scheduled timeframe, you will incur a storage fee of $100.00 per day per invoice. Items remaining 7 days after the removal deadline will be considered abandoned and no refunds will be given. Regardless of any agreed upon storage of your items, all invoices must be paid by the end of regular scheduled removal. You are still liable for paying for your item(s) and will be charged at the default credit card on file, regardless of whether not you have picked up the items.

Removal: Once a bidder has paid for and picked up their items, the items become the property of the winning bidder (buyer). The buyer assumes all risk of loss and damage to property from that point forward, including at the premises of the sale. Stocking's Auction Service reserves the right to ask and register valid ID of the person(s) accessing the removal site and/or removing any purchased merchandise. If you feel you have won an item and it is not shown on your invoice page, please contact the Equip-Bid office by 9:00 am the morning following the close of the auction.

Refunds: If you receive an item that is damaged, does not work, or is missing pieces and it was not listed as such in the description, you are eligible to apply for a refund. Otherwise, no other refunds will be given as there is no expressed or implied warranty of items. Please note that refunds are processed as soon as they are received but take 4-12 business days to process and return the money to your account.

Tax-Exempt Purchases: Tax-exempt forms must be provided to each independent affiliate—tax-exempt statuses are not stored with your Equip-Bid account. You must provide the appropriate resale or exemption certificate for each auction in which you make a purchase before that auction closes. To send Stocking's Auction Service your form, contact us at 816-244-0865. After providing tax-exempt forms to this affiliate, contact us to remove tax from each invoice and we will adjust your invoice before processing your payment.

Indemnity: Bidder accepts responsibility for and agrees to indemnify, defend and hold harmless each Owner/Seller and Stocking's Auction Service and their employees, governing body, officers, owners, affiliates, subsidiaries, directors, agents and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs and expenses (including reasonable attorneys' fees and expenses) related to, arising from or associated with Buyer's, his agents or representatives, use of the Site, including but not limited to personal injuries or property damage incurred on the sale premises or during removal and transport of any auction items or lots, and arising out of, based upon, or resulting from any breach or violation by Bidder of this Site User Agreement or any use by Bidder of the Site or as a result of a dispute with another Bidder.

Interruption of Service: Stocking's Auction Service cannot, and will not, be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. Stocking's Auction Service, in its sole discretion, may void any sale, temporarily suspend bidding and re-sell any items or lots that were affected by any malfunction. The decision of Stocking's Auction Service is final.

Liability: Stocking's Auction Service's liability shall be limited to the refund of the bidder's purchase price.

Limitations: The above-stated Terms cannot be altered except in writing by Equip-Bid.
