By placing a bid, you are agreeing to all of the following terms.

This auction will be a no-contact, credit card only, scheduled load-out auction.  If you cannot comply, please do not bid.  No cash accepted at this time.

GENERAL TERMS AND CONDITIONS FOR AIR CAPITAL AUCTIONS:

SCHEDULER:  We have gone to an online scheduled pick up only.  After you get your invoice, at the top of your invoice screen, you will see a scheduler for pick up times.  Select a time, and then be there during that time.  If you don't schedule, you won't be able to pick up.  If you show up without appointment, you will be required to get on your cell phone, and schedule the next available time, it may be 2-3 hours later, so please do so before you get there.  ***IMPORTANT*** Any items not picked up during the scheduled pick up time AND no arrangements have been made to pick up will be considered abandoned and forfeited.  Ownership will immediately revert back to the party with the primary interest (seller) and seller is authorized to sell or dispose of the product as they see fit. If you fail to pay for or pickup your item items will be returned to inventory, Equip-Bid may revoke your ability to bid, and NO REFUNDS WILL BE GIVEN.

AUCTION CLOSING DATE:  The auction will close according to the terms listed specifically within each auction. Any terms or conditions listed for a specific auction will supersede those listed within the general terms in this agreement. Along with closing date and time, item inspection, location and removal times will also be listed for that specific auction.

REMOVAL: Once an auction has ended, the items become the property of the winning bidder (buyer). Buyer assumes all risk of loss and damage to property from that point forward including at the premises of the sale.

BUYERS PREMIUM/SALES TAX: A fifteen percent (15%) buyer's premium will be added to each purchase. If you bid $100.00, at checkout you will be charged $115.00 plus sales tax based on the location of the auction. If tax exempt, contact Equip-Bid Auctions to provide tax exempt form.

PAYMENT:  All Cards will be RAN as soon as auction closes. If your card is DECLINED and not paid for by end of LOADOUT you will be disabled from bidding on further auctions.    Credit cards only accepted for invoices under $2,000.  All other invoices must be paid by cashier's check.

SECURITY POLICY: We respect and are committed to protecting your privacy. We may collect personally identifiable information when you visit our site. We also automatically receive and record information on our server logs from your browser including your IP address, cookie information and the page(s) you visited. We will not sell your personally identifiable information to anyone. Your payment and personal information is always safe. Our Secure Sockets Layer (SSL) software is the industry standard and among the best software available today for secure commerce transactions. It encrypts all of your personal information, including credit card number, name, and address, so that it cannot be read over the internet.

DYNAMIC/STAGGERED CLOSING: If a bid is made within the last 5 minutes, the closing time for that item will be extended five (5) minutes in order to imitate a live auction as closely as possible.

WINNING BIDDER NOTIFICATION: Notification of items won will be sent to you ONLY by email. It is the buyers responsibility to check your email (it may be necessary to check junk/spam email folder.)   Buyer can check their dashboard in their account to see any outstanding invoices, and items won.  If you feel you won an item, and it is not shown, contact the Air Capital Auctions office by 9:00 a.m. the next morning to have us check on it for you.

CAUTION TO THE BIDDER: For demonstration purposes, various pieces of equipment may be joined together. Do not assume a lot consists of more than one item simply because they are connected together. You are bidding on the item as it is described and not the item in the photo. Air Capital Auctions makes an effort to ensure the descriptions are accurate and the photos match as well. However, an error can occur in the listing and in that case it will be the description and not the photo that will be the item won. If you feel there is a discrepancy or error between a listing and a photo, contact Air Capital Auctions for clarification and notification of error.

WARRANTY & CONDITIONS OF ITEMS SOLD: All items are sold AS IS, WHERE IS, with NO WARRANTY expressed or implied by the lot number affixed to the item. This sale is to the business community as equipment and inventory without any implied or expressed warranty. Descriptions are believed to be accurate but not guaranteed. When not certain of the condition or use of an item, please bid accordingly.

CHOOSE WISELY: We want everyone to get a good deal, and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistake. Once bidding ends, the item is contractually sold to the highest bidder and that item is the buyer's property. When in doubt about condition, completeness or suitability for intended use, please bid accordingly. Air Capital Auctions reserves the right to add or remove items from an auction, split or combine lots, add minimum bids or reserve prices, cancel, suspend, extend or reschedule an item and/or auction event, and make changes to the auction closing, inspection, or removal times. Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

LIABILITY: Equip-Bid, Air Capital Auctions, and Seller's liability shall be limited to the refund of bidder's purchase price.

LIMITATIONS: The above-stated Terms and Conditions for Air Capital Auctions cannot be altered except in writing by Air Capital Auctions.

FOUR LEVELS OF PRODUCT DETAIL

1.  Factory Sealed:  Factory sealed auction items are automatically granted a 48 hour warranty (detailed below).  These items are new in box, never used, original product, in original box.  We stand behind the listing as described.  Being “new”, we have not checked for function / internal damage.  You may inspect/test before you leave. No refunds after leaving pick up location, contact manager right away.

2.  Appears New:  Item appears to be in new condition, not used.  They may or may not be in the original box.  They should work as expected.  You may test your item before you leave, if it does not work, you may return it for full refund BEFORE you leave the pickup location.  No refunds after you leave.  We inspect for the following:

• Does not appear to have been pre-owned
• Item is complete enough to run / work as needed
• Box may be damaged, however, internal contents are functional. 

3.  Open Box:  Open Box represents several conditions, such as incomplete, pre-owned, new but not verified for condition, untested, could be fully functioning, or DOA, we have not tested.  Please use inspection time to preview and test before you bid. Open Box items may not be returned, sold as is.  We highly suggest you preview open box items during our preview hours.  Call if you have questions.

4.  Damaged:  These items have known damage.  We will do our best to describe / picture the damage.  We don’t test for functionality.  These could be items never used / owned, such as a grill that had shipping damage to the lid, but never put together or used.  Could be scratch and dent or could be totally broken. We encourage you to preview damaged items during our preview hours.  Call if you have questions. Damaged items cannot be returned, sold as is.

*Any unmarked items will be considered “open box or damaged”

We sell thousands of products and take tens of thousands of pictures each month to help give you confidence in the listings we offer.  We will attempt to capture product photos that help you understand the condition of the products we are listing.  Even with the effort we take to provide a clear understanding of the product, we recommend that you preview open box and/or damaged items during the inspection and preview hours provided for every auction. 

***IMPORTANT*** We are not responsible for wrong or mistaken bidding. Please ensure you read the descriptions thoroughly and look at all photos. We use factory and/or stock photos for representation purposes only.

PAYMENT PROCESSING AND TIMING We process credit cards by 8:00 a.m. the morning following the auction’s close.  If you are tax exempt, please contact us before the last lot closes. To receive tax exemption, you will be required to provide the proper documentation.
