All items must be picked up on the day listed.  Any remaining items will be disposed of (no refunds given for products that are not picked up)

This is an online-only auction bound by all legal rights and remedies in the state in which the auction occurs. Do not bid if you cannot agree to the terms of this contract or are not able to pay and pick up your items within the specified terms of each auction. Auction-specific terms and conditions for this affiliate are as follows.

Inspection: This auction does not offer scheduled inspection dates. A appointment is needed during the posted timeframe. Please schedule a time to preview if the auction is listed as "By Appointment Only."

Payment: The default credit card on file with your account will be charged immediately at the close of the auction. If your payment is declined for any reason, you will not be able to pick up your items without paying. Payment onsite is accepted at this location in the form of cash. Invoices over $2,000 are not able to be paid by the credit card you have on file. You will need to pay with exact cash, wire, or a cashier’s check. Exact change is required on cash payments.

If you, as the winning bidder (Buyer), do not provide sufficient funds or fail to retrieve your item(s) within the scheduled pick-up times, you may incur fees. Multiple instances of not paying or retrieving your items will result in a permanent block from the Equip-Bid site. Any bidder caught opening a new account will be charged an additional $50 with the above warnings. This is considered fraudulent bidding and is not tolerated.

Pick-Up: If you are unable to pick up your items during the scheduled pick-up times, do not bid. By bidding in an Equip-Bid auction, you are legally bound to be charged for all won items and are agreeing to remove them from the auction location. In order to pick up your won items, you will need to schedule an appointment on your invoice page.

If you fail to pick up your won items within the scheduled timeframe, items will be donated, resold at a future auction, or held for up to 5 days upon request from the bidder for a $50.00 holding fee. The bidder must contact the auction managers during the scheduled removal time in order to make these arrangements. Any furniture or large items that have to be moved will incur an additional moving or removal fee based on the items abandoned. 

Regardless of any agreed upon storage of your items, all invoices must be paid by the end of regular scheduled removal. You are still liable for paying for your item(s) and will be charged at the default credit card on file, regardless of whether not you have picked up the items.

Removal: Once a bidder has paid for and picked up their items, the items become the property of the winning bidder (buyer). The buyer assumes all risk of loss and damage to property from that point forward, including at the premises of the sale.

Refunds: If you receive an item that is damaged, does not work, or is missing pieces and it was not listed as such in the description, you are eligible to apply for a refund. Otherwise no refunds will be given as there is no written or implied warranty of items. Please note that refunds are processed as soon as they are received but take 4-12 business days to process and return the money to your account.

Tax-Exempt Purchases: Tax-exempt forms must be provided to each independent affiliate—tax-exempt statuses are not stored with your Equip-Bid account. If this is your first tax-exempt purchase with L&L  Estate Sales, contact us at 316-461-1531. After providing tax-exempt forms to this affiliate, contact us to remove tax from each invoice and we will adjust your invoice before processing your payment. This information is required prior to the auction close.

Liability: L&L Estate Sales's liability shall be limited to the refund of the bidder's purchase price.

Limitations: The above-stated Terms cannot be altered except in writing by Equip-Bid.

CAUTION TO THE BIDDER:

For demonstration purposes, various pieces of equipment may be joined together. Do not assume a lot consists of more than one item simply because they are connected in a photo. You are bidding on the item as it is described and not the item in the photo. L & L Family Estate Sales makes an effort to ensure the descriptions are accurate and the photos match as well. However, an error can occur in the listing and in that case it will be the description and not the photo that will be the item won. If you feel there is a discrepancy or error between a listing and a photo, contact L & L Family Estate Sales for clarification and notification of error.

WARRANTY & CONDITIONS OF ITEMS SOLD:

All items are sold AS IS, WHERE IS, with NO WARRANTY expressed or implied by the lot number affixed to the item. This sale is to the business community as equipment and inventory without any implied or expressed warranty. Descriptions are believed to be accurate but not guaranteed. When not certain of the condition or use of an item, please bid accordingly and utilize inspection times.

CHOOSE WISELY:

We want everyone to get a good deal, and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistake. Once bidding ends, the item is contractually sold to the highest bidder and that item is the buyers property. When in doubt about condition, completeness or suitability for intended use, please bid accordingly. L & L Estate Sales reserves the right to add or remove items from an auction, split or combine lots, add minimum bids or reserve prices, cancel, suspend, extend or reschedule an item and/or auction event, and make changes to the auction closing, inspection, or removal times. Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
