This is an online-only auction bound by all legal rights and remedies in the state in which the auction occurs. Do not bid if you cannot agree to the terms of this contract or are not able to pay and pick up your items within the specified terms of each auction. Auction-specific terms and conditions for this affiliate are as follows.

Inspection: This auction is by request only and no sooner than 48 hours before closing of the auction. Schedule inspection using the contact information on these terms. 

Payment: The default credit card on file with your account may be charged immediately at the close of the auction. If your payment is declined for any reason, you will not be able to pick up your items without paying. Regardless of pick-up location, all payment arrangements must be made within one (1) business day (M-F) of the auction closing. If invoice payment arrangements are not made by this time, you authorize your card on file to be charged for the total amount of your invoice plus a $25.00 late fee. No late fees will be removed from an invoice once they are added. 

Payment onsite is not accepted at this location and must be paid via the Equip-Bid website using the card processing provided prior to pick up. 

If you, as the winning bidder (Buyer), do not provide sufficient funds or fail to retrieve your item(s) within the scheduled pick-up times, you may incur fees. Multiple instances of not paying or retrieving your items will result in a permanent block from the Equip-Bid site. Any bidder caught opening a new account will be charged an additional $50 with the above warnings. This is considered fraudulent bidding and is not tolerated.

Pick-Up: If you are unable to pick up your items during the scheduled pick-up times, do not bid. By bidding in a DMC Direct auction, you are legally bound to be charged for all won items and are agreeing to remove them from the auction location. In order to pick up your won items, you will need to schedule an appointment on your invoice page. If you fail to pick up your won items within the above timeframe, If you fail to pick up your items within the pickup times, you forfeit the items. Regardless of any agreed upon storage of your items, all invoices must be paid by the end of regular scheduled removal. You are still liable for paying for your item(s) and will be charged at the default credit card on file, regardless of whether not you have picked up the items. By bidding on this auction, you have agreed to the following:

- All funds paid towards items you have forfeited are not subject to a chargeback.

- Items that are forfeit cannot be picked up at a later date unless the bidder is notified by DMC Direct BEFORE THE END OF THE SCHEDULED PICKUP TIMES and both agreed to an alternate time of pickup. 

Removal: Once a bidder has paid for and picked up their items, the items become the property of the winning bidder (buyer). The buyer assumes all risk of loss and damage to property from that point forward, including at the premises of the sale. Bidders (or agents working on the bidders' behalf) removing items from the property are liable for any and all damages they cause while removing items.

Shipping: Shipping may or may not be available on this auction. Please review the shipping tab of this auction prior to bidding if shipping to you would be necessary.

Refunds: 

Our primary goal is your satisfaction. Unless explicitly stated otherwise in the individual lot description with the designation "Sold As-Is", every item listed on our site is covered by our full return guarantee.

Items are eligible for a full refund if the return is due to the product being incomplete (missing essential components) or non-functional (not operating as intended).

If an item is returned under this guarantee, you will receive a full refund covering the following costs associated with the returned item:

If you receive an item that is in a different condition that it was listed in the description/photos, you are eligible to apply for a refund within 48 hours of your pickup. Otherwise, we do not offer refunds. Please utilize offered inspection times to view items. Inspection appointments can also be made by calling/texting the auction coordinator listed on the auction. Please note that refunds are processed as soon as they are received but take 4-12 business days to process and return the money to your account.

To start the refund please email the information to jess@adigitalmc.com. Item must be returned to DMC during pickup times to get a refund. Those times will be sent to you via email and will be scheduled within 7 business days from you sending the email with the information listed below.

Tax-Exempt Purchases: Tax-exempt forms must be provided to each independent affiliate—tax-exempt statuses are not stored with your Equip-Bid account. If this is your first tax-exempt purchase with Equip-Bid Outside Sales, contact us at support@equip-bid.com. After providing tax-exempt forms to this affiliate, contact us to remove tax from each invoice and we will adjust your invoice before processing your payment.

Liability: Equip-Bid and Seller's liability shall be limited to the refund of the bidder's purchase price.

Limitations: The above-stated Terms cannot be altered except in writing by Equip-Bid.

Handling Surcharge: A $1.00 handling fee will be added to all lot items won at the end of the auction as to offset elevated processing costs.
